    Default Establishment of Residency As Opposed to Tenant

    My question involves real estate located in the State of: California My 68 year old brother has a live-in girlfriend. He let her son move in with them, who is verbally and physically abusive to my brother. He called the police and they removed him from the home and told him to call them if he returned. He returned at the invitation of his girlfriend who has established a residency there (14 years). The police suggested he file a restraining order against the son which he is in the process of doing, since she can invite the son back into the house due to her residency. The police also told him he now has to file for eviction of her because of the 14 years residency, which he will do. Will it speed up the process if he quit claims the house which he owns outright, to me and I tell them they have to leave? Their intention is to try to have my brother committed (how I don't know) then take over the house. They also claim they have contacted the DMV telling them he is an unsafe driver and they want his license yanked. He just got the license renewed for 5 years recently.

    They are entitled to 60 days notice to vacate. No shenanigans you try and pull will allow you to circumvent the law. On the 61st day, if they haven't left, he can file an eviction case.
