    Default Change in Custody and Child Support

    My question involves child support in the State of: Michigan

    My fiance has three daughters with his ex wife and back in 2008 he was ordered to pay 428 a month for the support of his daughters. Well since it took a year for the order to go into system and they go back to the date the motion for child support was filed he gained having to pay also on back child support once he was ordered to start paying his child support. Hope that all made sense for everyone. Anyhow at one point he got a bit more behind because he got injured while working, basically about cut off three of his fingers. Well here in Michigan if your behind in back child support in a larger amount you can be charged with a felony. Well after he returned to work and was paying again the regular amount and just a little bit extra here and there when he had it to pay off the back child support his ex started demanding to him the whole back child support right away and he was not able to just come up with 7,000 on the spot so she had him charged with a felony. To make things short he is now on probation for it all etc. Well two months after being put on probation for the back child support his oldest in which is legally blind had an altercation with her mother and came to live with him. Well he just got the revised support order back and now his ex is ordered to pay him 512 a month. I know you must be wondering why has to pay him so much when she has the other two. Well that is due to her making 2900 more than him a month in which based on her income she would be paying 599 a month for one child and on his income he would be paying 98 for two. The 11.00 its medical part of the support. My question is this he wants to know if the amount she is ordered to pay to just be applied to his back child support, or do they start all over. This is all new to him so he just wants clarification as to what will be done since the circumstances have changed. Oh and also the child support for his oldest would only be for another yr and a half because she is turning 18 this summer but has one more year of high school left after she turns 18. In the order its until they reach 18 or 19 and a half if still in school. So if anyone has any insight on this please share.

    Her present child support obligation is a payment toward the support of the children, not a self-directed payment toward his arrearage. She pays what she owes; he pays what he owes.
