How do you maintain US Residency after divorce from British wife when your only allowed in US through the marriage? (Her parents are now US citizens and will help her stay in the US. The other side of the family was left behind.)
Married 10/29/05 in England, moved over to US live in US now for 3yrs and 7mths, Permanent Resident 9/30/06 expires 10/25/16, Visa stamp on passport says only if accompanied by spouse. Male seeking divorce but wishes to continue to reside here in America, established life here with friends, home, and employment. Wifes parents will help her remain here in the US but say Husband will be required to return to England after divorce. Is this factual or can residency be maintained after divorce?
Visa stamping is only for entry and does not affect you once you are inside the US. I suspect this was to insure that you were traveling together and that the derivative spouse would not enter alone while the primary spouse remained in the UK.
I assume you both now have green cards in your possession. There should be no problems with both remaining.
I suggest that you review the entire situation with the family law attorney handling the divorce - particularly if there are children involved.
