It has been more than 30 days since the end of lease, which ended Jan 31. And I have not received my deposit back, nor any documentation describing why it was with held. I intend to sue my former landlord in small claims court. I'm seeking information related to the following.
I was wondering if it would be possible to place a lien against the property as he is currently trying to sell it.
Also, i paid an animal deposit when i moved in, the lease does not say this is no refundable. But it does say, "Lessor has the absolute discretion whether to refund the Animal Deposit to lessee in whole, in part, or at all, and lessee shall have no claim against lessor with regard to any such refund of lack thereof." Since it is past 30 days, can I seek to be reimbursed for this too?
And my I seek double the original amount of deposit as allowed by MO statutes for both the rental and animal deposits.
The animal in question is a small cat, i seriously doubt it did any damage whatsoever to the property and i vacuumed and shampooed the carpets myself before i moved out.
