    Default Divorce for Expat Couple

    My question involves a marriage in the state of: ?

    (Apologies for posting undoubtedly the 47th instance of this question, but my forum searches were fruitless.)

    My wife and I have lived overseas for 10 years, and are in the process of divorcing. We have agreed to the basic terms of child custody and property division, and since we both earn equivalent salaries, we don't anticipate child support or alimony payments.

    The only real problem is: in which state do we file the divorce? We have nominal residency in Florida, but have very little physical presence, and no property, in the state. Prior to moving overseas, we lived in Georgia for several years.

    We're both U.S. citizens, and are not interested in filing overseas. We'd like this to be as quick and painless as possible (i.e. entering our agreement in court and being done with it). Any suggestions?

    Do you still retain LEGAL residence in the US?

    Yes, my legal residence, including voting district, is in Florida. It would be appropriate to disclose that I'm overseas on official U.S. government orders, so I maintain my legal residence despite long absences.

    If you're both legally domiciled in Florida, that would be the state in which you would file. You should expect that you, your spouse, or both will have to travel back to Florida for at least one court proceeding.
