My question involves a child custody case from the State of: New Jersey.. My daughter went to court a couple of weeks ago to straighten out custody and visitation with the father. my daughter is 20 the father just turned 19, he just got off probation for possession of pot. he has never paid any child support (baby is 7 months old) my daughter has been very fair to his family and allowed them to have the baby 2-3 days during the week and pretty much for about 8 hours on sundays. In addition we had a christening party for her and my daughter & the father opened a savings account with the gift money the baby received and he took $1100.00 out of it wipping it clean.
they went to court and met with mediator who ordere him to pay $50.00 per week and gave him every tuesday and every either friday or saturday nights 6pm to 6pm alternating every week in addition in 3 months he will have her overnight on tuesdays as well. the mediator told my daughter that if she went before a judge he would get even more overnight probably at least 3, so she signed the mediation paper. When she came home and i told her that she should have went before a judge she told me what the mediator said and i had her go back to the courthouse and refile.
The big problem we just round out that her x-boyfriends aunt works in the courthouse she is in a management position and when he had to go to court for his possession charges he had to be moved to a different district because of the conflict. We feel that a judge would not have given him any overnights at this age (7 months). my daughter is devistated, she is a good mother and spends all of her time when not going college with her daughter. What can we do? Can we fight this and have it mover to another court?
