    Default Accident at an Intersection

    My question involves a traffic accident in the State of: Texas

    I was going straight through an intersection and before I made it through the intersection the light turned yellow. Just as i had a person making a left at the intersection and i hit them.

    The other person involved stated that i ran the red light but according to a witness after they saw the accident in the rear view mirror they saw the light turn red. When the officer arrived they took our stories and at first the other person stated they had a green light and when her husband came changed her story and stated that she had a green arrow. The officer noted that she lied and changed her story.

    At first the insurance made the decision to pay 70/30 percent of damages and injuries stating that i was 30 percent at fault because i was driving negligently. They made this decision before the police report. After the report was presented to them they changed and stated that I was speeding.

    Had the person not made the turn and took my right of way my car would not have been destroyed and i would not have been injured. Which is why I am currently in a lawsuit with the insurance company. It doesn't seem to be progressing at any rate but slowly and I need to get assistance that my lawyer doesn't seem to be providing.

    With the witness statement and police report I would think it would be obvious that the other person was 100 percent at fault and i know that insurance companies will do whatever they can to not pay as much as possible.

    Any hints as to how to get this to progress faster? Things i need to inform my attorney?

    Litigation is a slow process. You can discuss your options with your lawyer, but if you're paying by the hour it could cost you a considerable amount of money to try to "speed things up"; and if you're paying a contingency fee I am not expecting that the claim is so large that the lawyer is going to pour extra hours into preparing and filing motions at a significant cost to his bottom line.
