Default Texas Auto Accident - personal injury claim, on my own insurance

I was involved in an auto accident (rammed from rear) in Jan 2006. The guy at fault paid up for the auto damage.
however, my accident lawyer want to make a claim on MY insurance for medical charges incurred. He says that making a claim for the personal injury (medical coverage) does not affect my discounts or insurance rates.

Is he right? please let me know asap.

This happened in Dallas county, and my insurance company is Allstate.

I'm not sure what your issue is. Is it that you would prefer to pay your medical bills out of the settlement (your own money) rather than having your own insurer pay those bills?
