    Default Fifteen-year-old daughter drove my car and got caught

    Hello....I live in Illinois. My 15 yr old daughter and her boyfriend attempted to steal my car a month ago. She was driving when the police stopped them. Since it was my car that they took, (& this is the first stupid thing she has done) I am even more uninterested in paying her bond when she has to go to court on 7/12. What am I liable for? She is charged w/driving w/o a license plus she is not eligible to drive. Do you think if I sought legal council locally that they could (talk to presiding judge) and find a way to punish her that doesn't include me paying her bond $$? I am thinking maybe some kind of community svc and if she doesn't follow thru with that then a stay in a juvenile center for a wkend. Your thoughts/opinions are appreciated. Thanks.

    Was she charged with attempted theft, grand theft or joy riding too, or just w/driving w/o a license? Was the boyfriend charged for anything also?

    charged w/driving w/o a license. To my knowledge the boyfriend was not charged. (wish he had been) And yes I love my daughter but all the sh** that she has done over the last couple of years makes me wish they had charged her w/more. She needs to know & understand that there have to be consequences for her actions, since she doesn't listen to me.

    My response:

    Because she's a minor, and because you allowed the keys to the vehicle to be available, you will be required to pay all of her court costs, fees, and costs of all diversionary programs she is sentenced to attend. She will also lose her privilege to obtain a driver's license until the age of 18.

    Be proactive, and obtain a Restraining Order against the boyfriend.

    Got the restraining order against her boyfriend last week, go to court on 7/21. The keys are not ever available to her. I had hidden the second set. (had to go out of town for a day on biz and removed them from my purse to make it lighter) The situation is interesting because she didn't know I had removed them from my purse so she must have been doing a normal "snooping" and found them. I have found that she has gone through my room looking for stuff. I have removed anything of value and installed a keyed entry to my bedroom.

    So if she is liable for paying the bond/court costs, etc. my questions are; what if she doesn't show up? She knows when the court date is. What am I liable for since she is only 15? Am I the one that actually will pay for those fees? Finally the diversionary programs you mention, what are those and if she doesn't go what are the consequences?

    My response:

    Like I said, she's not "liable" to pay anything. You are.

    If she fails to appear with YOU in court, then a warrant will be issued for her arrest, and when she's arrested, it's off to the Juvenile Detention Center for her.

    The diversion program most commonly used is "Community Service" - - an example would be picking up trash in parks, cleaning out sewers, dishing out food at the "Poor" soup kitchens, clearing brush in the mountains, etc., including the loss of her potential license until age 18. She will probably be "hit" for 20 to 50 hours worth of Community Service, and she will have no choice concerning how and where such service will be completed.

    Altogether, you can figure spending around $1,500 to $2,500 for all costs, fees and fines.

    Obviously you have had trouble brewing for a while and you are going to have to do more than putting a lock on your door. Most likely you will also have to appear in court with her. What ever her sentence, you can add to that at home and make her work off all the related costs. You can also be proactive at home, get an igniction interrupt installed on the car, removing the door to her room from it's hinges, take away all priviledges until she has served her sentence and paid for all the costs, take away cell phones or get one that is restricted to calling your number only, take away TV, CD, DVD,computer, games. except for homework and then only if needed it won't hurt her to learn how to write, type on a typwriter, do math without a calculator, etc. Basically, tough love (3 hots & a cot). If you have to leave town, again, be sure to proivide for her supervision and no access to your house, also while you are at work, so you may want to change the locks on the main doors and install door alarms, the ones made for "baby's" if she is inclined to sneak out.
