    Default Held in Contempt of Court Based on My Husbands Income

    My question relates to legal practice in the state of: Colorado

    I was found in contempt of court and ordered 10 days in jail because of a small claims debt that I have not had the money to pay. The plaintiff did not have an attorney and the judge asked me why I couldn't pay and I told her that I don't have a job right now.
    She then asked me if my husband worked and I told her yes, so she found me in contempt of court.. Is this legal since my husband is not even a part of the case????

    Well, your husband isn't party to the case, that's true - but it does indicate that you have household income that you could use to pay the debt and are simply choosing not to do so.

    I'd speak to a local attorney immediately if I were you.
