My question involves a traffic accident in the State of: Colorado

I approached a stop sign where another vehicle was stopped in the middle of the road, the street is wide enough for 4 vehicles, but has no painted lines. It is a side road crossing a very busy 6 lane road, it is possible to turn left, go straight, or turn right. Due to the high volume of traffic it often takes 10 minutes or more to turn left. Since i moved to Colorado last year, people always drive around the right side of vehicles turning left or going straight, and make a right hand turn.

Scenario: Vehicle stopped in the middle of the road with no signal on, I pull around the right side of him up to the stop sign and await the traffic to slow, he's on his cell phone (not illegal here... morons) and he turns right, smashing into the front left side of my car and knocking the fender off. He drove approx 1/2 mile down the road and parked and walked back waiting for the police. The police officer issued me a ticket for overtaking on the right side. He also failed to inspect the other persons vehicle.

I have a court date in 3 weeks, and have to until then to prove my innocence.

Would it be prudent for me to take pictures of other vehicles safely making the right hand turn while vehicles were stopped in the center lane?
