    Default How to Remove My Stepfather's Name from My Birth Certificate

    My question involves name change laws in the State of: IL
    I was born in Chicago, but currently live in Nashville, TN.
    I would like to remove my stepfather's name from my birth certificate. He didn't legally adopt me.
    When I was born, my mother didn't put a name in the father's section of my BC. Of course I received my mothers last name.
    When she met someone and got married, she decided that she didn't want her children to have different last names. They didn't have the money to have him legally adopt me, so she lied. She told the clerks office that he was my biological father, but they were apart at the time of my birth. They were now married so she wanted to correct it. Well back then they didn't question paternity with a DNA test, so they assumed she was telling the truth and changed it.
    So according to the courts, he is my father.
    The reason for me wanting to change it is because my stepfather was an abusive man and I have nothing to do with him. My mother is still married to him, but I am estranged from her as well. I do not want to keep his name on my BC. I am married with children of my own. I just want to finally be able to put my past behind me and I really believe it would help that I don't have to look at that last name on any of my documents.
    Please help!!!

    It looks like Illinois allows adult adoption under circumstances that probably don't apply (it appears that you would have needed to live with the prospective adopted parent for at least two years in a parent-child relationship before turning 18) and Tennessee permits adult adoption but that the process would terminate the status of both birth parents; I don't know the extent to which either option seems appealing to you; also, Illinois offers little relief in the way of how it amends a birth certificate - "a line is drawn through the information being corrected and the new information is placed above or beside". You can consult a family lawyer for further investigation, but I don't see a simple or obvious way to achieve your desired goal.
