    Default Marital Assests

    My question involves divorce in the State of: South Carolina


    Currently all of our major debt is in my wife's name. I know that she wants me to keep the house and although I am listed on the Deed the Mortgage is in her name. My credit is in poor shape but our state requires a 12 month separation and I think I can pull my score up enough to purchase the house by then.

    The questions I have are around my vehicle and our boat. Since the boat was purchased new 3 years ago it will not be possible to sell it but she wants me to keep it until I can finance it in my name. My Suburban is 15 months from being paid off and I will need something to pull the boat with. I could easily trade out of the Suburban because I owe about $10k less than the trade in value.

    So my question is... If I keep these items and make the payments what can stop her from deciding to take the truck a month before I make the last payment. Right now everything is civil but I know that can change during a divorce.

    You can address the issue of who is responsible for payment of various loans, and who receives the right to keep various items of property, in your divorce judgment.

    So if the Divorce allows me to keep the vehicles and I pay them off she will have to sign them over once the lien is lifted by the bank?
