    Default Overstayed J1 and Getting Married

    Hi,

    I came into the country legally on a J1 visa as an Au Pair in 2004. Couple months later I met my American boyfriend. I finished my Au Pair program and moved in with him in 2005. We have been together ever since. I am now pregnant (due in July)and we want to get married. (we have been wanting to for a very long time, Just didn't have enough money at the time)

    I am not subjected to section 212e.

    My question is, after we get married do we file for a I-130 and I-485 or is there more to it? I did work on and of as a babysitter (under the table), does that count against me?

    Please if anyone has any advise I would really appreciate it. Thank you for reading my post.

    Legitimate marriage to a USC forgives much. You should seek the assistance of a social service agency that assists immigrants since you appear to have financial problems filing. Catholic Charities and Lutheran Relief are two respected agencies. I suggest you do so because you cannot afford any mistakes with a baby on the way.

    I have one more questions, Do we file the I-130 and I-485 at the local USCIS field office or do we send it somewhere else?
