    Angry Eviction After Foreclosure in Texas

    My mother is facing eviction below is the situation she is in. What are her options? This is current referring to last Friday last day of June.

    The property was foreclosed on earlier this month. We accidentally found out last Friday when they turned the water off. We sent our rent in but when J.A.M. found out they were no longer the managers, they just didn’t pay the bill.

    Harold made many phone calls to the manager, and both water departments (FW and Richland Hills) and after a while he got a call from a Fannie Mae realtor. He told her what happened and she made arrangements for the H2O to be turned back on. He also got the name of the foreclosure attorney and called the office. Of course only the secretary was there. They thought we had gotten our eviction papers…they sent them to the bankrupt former owner xxxxxx in California and nobody bothered to see if we had been notified. I was served eviction papers at 8:30am Monday morning and the Constable suggested we move ASAP. There is a foreclosure hearing on Monday, which Harold will attend, and plead to give us more than one week to get out. We are moving, literally, across the street to xxxxx.

    The mortgage company wants everyone out, in spite of the fact we’re good tenants, so the place will be empty when they put it back on the market.

    J.A.M. being the property management company?

    This eviction is for what? Nonpayment of rent?

    Mortgage company is foreclosing on property. The defaulted owner is in California. Mortgage company forcing eviction issue. No tenants received any notice. Notice was sent to management of apartments which did not inform tenants.

    Tenants usually take possession subject to any mortgages, which seems to be the case. Moving is the only option when the mortgagor doesn't want to be a landlord. At best a fight would postpone the inevitable!

    They had a hearing today in front of Tarrant County Justice of the Peace Barbara Ferrell. She gave them until 07/17/2006 to get out. Another tenant has a hearing before her on the 17th. Sounds like they are being forced to move before all of the tenants have their hearings. Something does not sound right.
