    Default Domestic Violence Felony

    My question involves criminal law for the state of: Florida

    The State had filed criminal charges against my ex for Domestic Violence. He is charged for Battery by Strangulation (Felony) and I believe just Battery (Misd.). I know that he is trying to settle everything outside of court, does that mean that the charges could be dropped? Wouldn't he have to plead guilty to settle for a lesser charge like Batterer's Intervention?

    I have picture's of my injuries and since only the arraignment has occurred I haven't showed them to anyone. Should I mention to the State Attorney that I have pictures in case he pleads not guilty?

    Pretty much, is he going to get away with it?

    They can negotiate out of court, but generally, the charges will not be dismissed or modified until he goes up before a judge. You can certainly offer the pictuers to the prosecutor. You may also check with the State's Attorney's office's victim's advocate who probably can assist you.
