    Angry Borrowed Car Towed and Impounded for 30 Days Due to Driver's License Suspension

    My question involves towing laws for the State of: California

    My California driving privilege was suspended pending an SR22 filing. My driving record is perfect. I got the SR22 last Friday and my insurance agent said they would electronically file it with the DMV. I got pulled over on Saturday and the officer towed my sisters vehicle and put a 30 day hold on it! I contacted my insurance lady and she assured me that I should have no problem and that the date I received my policy is the date of reinstatement. Should I be worried?

    Worried about which part? The suspension or the impound? Either way. I'll try to address both.

    When your license is suspended, the DMV usually requires you to pay a reinstatement fee ($55 or so) before your driving privilege is reinstated. So you'll have to contact the DMV and ask them how to proceed assuming that they now have proof that you have fulfilled the SR22 requirement.

    As for the impound, if you leave the vehicle there for the duration of the 30 day hold, you're looking at a huge amount of money to pay for towing and impound/storage fees. If the vehicle is registered under your sister's name, she should be able to request a hearing with the law enforcement agency that ordered the hold, to see if she can get her vehicle released earlier in an attempt to reduce the impound costs. She must request the hearing within 10 days after the hold and the agency must schedule the hearing within 48 hours after her request.

    I see. I knew it would be a huge fee if left in impound. That's very interesting aabout the hearing. Thank you.

    Regarding the date of reinstatement: my ins agent assures me that once I pay the reinstatement fee, the date on the reinstatement should equal the date the policy was purchased. Any idea if this is true? Thanks again for your answer.

    Here is how I understand it: Step one would be to get insured, step two would be to either have your insurer notify the DMV or provide you with proof of insurance via an SR-22 (which you can take to the DMV), and step 3 would be to go to the DMV to pay the reinstatement fee and have your driving privilege restored. Those steps must be done in that order otherwise your license is still suspended. So just because you purchased a policy does not mean that your license becomes valid... Not until you pay the reinstatement fee!

    But, ultimately, the decision is up to the DMV. If I am incorrect, I would greatly appreciate it if you can come back and let us know. Thanks
