    Default How to Evict My Daughter Out of My House

    My question involves an eviction in the state of: PA

    I must evict my daughter from my house. She does not abide by any rules. She will leave my grandson with me even after I tell her that I am not willing to babysit. Although, I really love him. I just don't want her shirking parental responsibility. She has custody of him every other week. I have requested that she not go out during her custody week. She does not pay any rent.

    What is a formal eviction? Do I write a letter and have it notarized? Or, just give letter with 30 day notice, initially, then go through courts, if she refuses to leave. Or, do I need to contact the court to start the eviction?

    Evicting an adult guest from your home may well be a simple matter, but I do not know what it is.

    At worst, you could follow the procedure for evicting an adult paying tenant.

    If your daughter is a minor you can't evict her. If she is an adult tell her you want her to leave and if she doesn't call the Police and they will forceably remove her, you need only tell them she is not a wanted guest in your home, you have asked her to leave and she refuses. If you have a contract with her for rent , and she must be 18 years or older to enter into a contract, you then have to go through procedures of PA law to have her leave, following their eviction process, that can be as simple as filling out forms and having them hand delivered to her. If she was granted partial custody of the child or court ordered visitation, you can go before the judge, if not you might want to seek a child advocate of the court, however, be aware that if she is found to be an unfit Mother, she may loose complete custody or visitation until her situation becomes more stable, so this has it ups and downs. If you daughter is getting any type of help from the state you may also report her if she is getting assistance, living with you and not paying rent, if that is the case. Most of all don't feel guilty because you are trying to help her to become more responsible for her child as you said you love your grandchild, do what is best for them.

    Contrary to the above, if your adult daughter won't leave on her own accord, the police may tell you that you have to evict her even if she has never paid rent.
