    Default Recourse for Unpaid Rent if No Eviction Notice is Served

    My question involves an eviction in the state of: MA

    I have been searching for this for a while but just haven't found a clear answer. I know of a small business that hasn't been able to pay rent for close to a year now. However, they were never served an eviction notice, so they just ended up staying there, prepared to move out once an eviction notice was given.

    What is the landlord's recourse? Can the landlord file a lawsuit to recover all unpaid rent (1 year), even though he never evicted the tenant?

    The contract can be enforced for the duration of the statute of limitations.

    Yes, the law does not require that a tenant be evicted. The entity will owe the rent for time that they are using the facility.
