You can sue the primary borrower for the amounts you have to cover.

You should be able to sue in a regular trial court if you can establish that California has jurisdiction based upon his former California residence and you're all entering into the contract while he was in the state. For small claims (max. $7,500 per claim) you would have to serve him in California.

What if the primary borrower moved out of state? His former residence is in CA, but he moved to a different state (and I do know where they live).
If it's more than 7,500, i would go to regular trial, would i have to apply for both CA and his current state?
