We have around Eight acres of land that joins the rest of our land. This eight acres can only be acessed through our neighbors land, there is a creek and a cliff/bluff in between the eight acres and the rest of our land. Our neighbor has always told us to use the road to get to our land at the time she was out of state. So we kept the road up, mowed the road, and cut the dead trees out of the road for 40 years. Now she has came and built a house and gave some of her land to her kids. We have asked her for a right of way for years and she said just use it not to worry about it. Now both her and her kids have freaked out about us using the road. Can a Judge force her to sell or give us a right of way being that we have kept the road up for forty years, and have no the other way in?
