    Default North Carolina Father Trying to Make Me Bring Our Daughter to a Different State

    My question involves a child custody case from the State of: California
    Hi I got pregnant in 2008 at the time I live with the father but he kept telling me I need to have an abortion. So I moved back to california my daughter was born here. WE tried to work things out but when she was seven months old he left back to arizona. Since 2009 he has come to visit 3 times and when he is here he really doesn't spend much time with her I'd say about 20 ti 30% of his time while in california. He has been emotionally abusive to me in the past but I was too afraid to ever get a restraining order. Now that he has been severed with a proposed judgment he calls and tells me he wants to spend time with her and he thinks I should drop her off with him in arizona for a couple of weeks. I don't plan on doing that but ,y question is what do I need to do to get custody and him gradual visits I want her to know him but I don't what to leave her with him when he has never spent more than 3 hours alone with her since she has been born. He tells me he lives with a friend but I have no Idea if that's true he has no phone right now but wants me to drop her off. she has never even spent the night away from me. She has lived with me her whole life.

    does that judgment have anything to do with the child?

    so, is there a legal father? Did the guy sign an affidavit of paternity?

    If there is no legal father, you don't have to do anything unless you want to.

    If he is the legal father, you can still deny him visitation. He will ahve to file with the courts for custody and or visitation. You can also file for custody and or visitation as well. If he is the father, the court will likely institute short visitations initially and then eventually increase it to overnights.

    So, where does the paternity thing stand right now?
