Default Minor Name Change Due to a Dead-Beat Dad and Mother is Getting Married

My question involves name change laws in the State of: TEXAS

My child is 6yrs and has my last name. The father is not on the birth certificate nor is he or has he ever paid child support or seen her since she was 3weeks old. However I am currently going through CSE office to change that. I am getting married and of course my name will be changing and she would like to assume my husband to-be's last name.

My question is that of will it be possible for me to do this at this time with the proceedings i currently have in process? Or would it be better to wait and do it after everything is determined with custody agreement and child support? And if I did it now since the father is not listed would it be possible that I wouldnt have to have his aproval?

    ~Thanks~
