    Default TERI student loan and Chp 7 Bankruptcy

    My husband and I declared Chp 7 Bankruptcy in 2004 in the state of Georgia. We were discharged of all debt, we thought. Shortly after discharge, a collection agency contacted us concerning our TERI loan. They said that it was not dischargeable loan. I contacted our attorney who did the bankruptcy (free of charge). At the beginning of the bankruptcy he researched the loan and said it was dischargeable, and when I later asked him about the collection agency and the loan, he said it was not dischargeable. Afraid of action by the collection agency, I have been making small payments. I have recently been more bold and have begun questioning all events. Is the non federal student loan set up through TERI a dischargeable loan?

    A TERI loan will generally not be dischargeable in bankruptcy.
