    Default Difference Between Small Claims Court and Lawsuit Over $5000

    My question involves collection proceedings in the State of: NV

    I won a small claims lawsuit several years ago. During that process, the defendant never showed up to any of the hearings and he never had to provide any proof of assets. It was totally up to me to find any assets he owned and try to get paid. There was no such thing as a "Creditor's Exam" hearing. There was no subpoenas issued or hearing held for him to provide (under penalty of perjury) list of his assets.

    Is this any different than if I were sued by a credit card company for unpaid debt over $5000? Is the creditor's exam hearing a "must attend"? If I lose a lawsuit, will there be a creditor's exam that I must attend? What happens if I lose a lawsuit and I do not appear at the creditor's exam?

    If a creditor's exam is held you can expect to be subpoenaed to attend and, should you fail to appear, that the plaintiff will seek a bench warrant, contempt citation, and/or additional costs and fees.
