    Default How Long Can a Case Stay on the Arbitration List

    My question involves collection proceedings in the State of: PA

    Some time ago (7/2/2009) I was sued by Citibank for credit card debt (a debt collector is handling it) & was served. I answered back the letter to the court, & filed it.

    I can not remember ATM who the debt collector is, but I have not heard anything back from them since 7/2/2009.

    When I check on the status of the case it says it is on the "arbitration list"

    My question: Is there a limit that this case can be on the arbitration list? Can I have it dismissed since it has been so long?

    File a motion to dismiss for lack of prosecution along with a certificate of service that you mailed it to the plaintiff.

    Chances are they don't have the underlying paperwork to prove the claim anyway. Few third party collectors get the required paperwork to actually win in court when they obtain the debt.

    Wow!

    Soooooo weird. Anyways, I hadn't thought about this whole thing for a long time until yesterday & decided to post. I received a letter in the mail from the collection agency that is attempting to settle this lawsuit TODAY!

    The agency is Burton Neil, & Associates. I received the today, & it is offering a settlement if I sign & agree to their terms.

    The amount owed to Citibank is $5695.90 plus court costs of $193.05. They are offering to settle for $3,840.00 with a payment plan of $320.00 over 12 months.

    My question: Is this a great offer? Could I negotiate since they are offering me a settlement w/o going to arbitration? Should I ignore this, & wait? Counter offer? Etc.... What are my options?

    That is weird certainly.

    I still recommend you follow my previous suggestion.

    Did they provide a copy of the contract? You need to know if they can prove the case.

    If they have not pursued the case for this long, chances are there is something seriously wrong with it.
