My question involves an eviction in the state of: Pennsylvania
My mother has an apartment with a one year lease and she is the only person on the lease. She allowed my brother to stay with her from the time she moved in with the understanding that it was a temporary thing and he would need to get his own place as soon as possible. He made a few small contributions to the rent/utilities during the time he was there (about 4 months). A few weeks ago the police came looking for him for unrelated criminal activity and found him in possession of narcotics, baggies, a scale, needles and other assorted drug paraphernalia. He is currently in the county jail awaiting trial on possession with intent to distribute and other assorted charges. We don't expect him to be released in the near future as he has no way to pay his bail but the county jail is quite overcrowded so you never know if the bail will be dropped to an ROR. My mother does not want him to be able to return to the apartment upon his release under any circumstances due to his criminal activity (drug dealing/use) and his generally abusive attitude towards her. How should we proceed with evicting him from her apartment so he cannot return upon his release? Again, he is not on the lease and was involved in criminal activity on the premises. My mother does not want to get a Protection from Abuse Order and we don't expect any assistance from the landlord in this matter.
