    Default Got Sent a More Expensive Item from an Online Retailer

    My question involves a consumer law issue in the State of: GA

    I ordered something online and something else came in it's place, of much greater value. It was purportedly from the vender but they don't even sell this item. Near as I can tell, it was a warehouse issue.

    Frankly, I'd like to keep it. What are my rights to do so?

    Please, no morality messages back. I consider this a karma issue, since I recently sent a school a missing laptop back, and that saved them thousands. All I'm looking to understand, are my rights and my legal liabilities.

    If the vendor contacts you in relation to exchanging the item mistakenly shipped to you for the one you actually ordered, you have the 'right' to cooperate with the exchange or to attempt to negotiate for the purchase of the more expensive item that was mistakenly delivered to you. A fulfillment order is different from the shipment of unsolicited merchandise.

    I would also assume that failure to comply would expose me to legal liability.

    Oh well. If they contact me, then I believe you are telling me I am compelled to return it. If that is true, so be it.

    Maybe they never contact me.

    Although I wouldn't expect them to suggest otherwise, you can demand that they cover all shipping costs. You should not take a financial loss fixing their mistake.

    And who knows. Maybe I buy the item, outright, but I would need a little 'give' on their side. The best I could do to pay is maybe 50 a payroll (on a 550 dollar item).

    It all depends if I get a notice that THEY noticed.

    Why not just call them?

    That would, after all, be the right and legal thing to do.

    Oh yeah, then you wouldn't get to hope they don't notice a $500 mistake.

    I assure you, unless they have an inventory control system built in the 1970's, they will know it.
