My question involves bankruptcy in the state of: Florida
I filed for bankruptcy on April 30th, 2009. Subsequently, my debt was discharged on August 29th , 2009. Even though I never legally reaffirmed the loan, I continued paying the loan secured by my truck on time until April of the following year. As life would have it, I was hospitalized for nearly three weeks and spent the first six months of 2010 on medical leave. As a result, all of the sick and vacation time which I had accrued during my time with Manatee County was consumed by April 2010. During the remainder of the year my sole income was derived from a part time job. Nevertheless, I continued to make the loan payment. However, payments were now a month behind.
Needless to say, once I fell behind the situation only worsened and at the beginning of last month I received a letter from the lender which contained the following:
“You are late in making your payments to SunTrust Bank on the above-referenced loan. If you pay the TOTAL AMOUNT NOW DUE ($1509.57) by February 16, 2011, in addition
to any payments that will come due on or before the LAST DAY FOR PAYMENT, February 16th, 2011, you may continue with the contract as though you were not late”.
Another paragraph advises that if the default is “cured” by the last day for payment, they will assume future payments will be timely.
During the past month I was able to pay the past due payments owed and presently the only payment due is for the current month. However, SunTrust advised me that there is a repossession order out for the truck and my only alternative is to pay a fee of $1636 plus this month’s payment which totals just over $2000. Unfortunately, unless it suddenly starts to rain money; there is no way for me to come up with that amount which brings me to my question: are there any options available to me or should I just get my stuff out of the vehicle and drop it off at a branch?
The receptionist at the law firm I used to file told me there was nothing they could do, but she volunteered that after telling me there wasn't anyone that could answer my question was in the office at the time.
