    Default Accused of Shoplifting

    This is how I planned my day of July 2nd, 2006….I was to leave the house with my daughter around 10:00 AM and go to Macys to buy a pair of pants, flip flop and maybe a t-shirt and also to check on the price of a purse. I wanted to go for lunch after with my baby and come back home early to put her to sleep for a good nap so she would be rested for a post wedding even that we were going at around 4:30pm…which I was buying the pants for….

    Instead this is what happened…..

    I left the house and had a flat tire on my way to the mall…a gentleman stopped and helped me with the flat tire…so by the time I got to the mall it was about 11:45am…I parked my car at the Macys store. My daughter was doing pretty good…so I decided to try some shopping before lunch….so I went around the store looking at what I could find…I had about 7 shirts and about 5 pants and a pair of short…so I went to find a fitting room….As I’m starting to try on the clothes my daughter is getting fussy…so I get her out of the stroller and let her stand up in the fitting room..and I continued to try the clothes…and she’s starting to get fussy again…so I put her back in the stroller and gave her a bottle…so I can continue to try the clothes…so I decided I was keeping an orange shirt, a pair of short (was too small but wanted to keep anyway as I am on diet and losing the baby weight) and a pair of pants…but my daughter is getting fussy again and I see that I’m getting thigh on time…so I decided to put the pants I was keeping on (to save time) with the intention to pay for them at the same time that the other items (shirt and short)…so I took the tags off put the pants on and put the short I was wearing in the stroller…and put the tags in the pair of short that I was keeping. So I walked out of the fitting room wearing the pants and with the shirt and the short in my hand…and left the rest of the clothes in the fitting room….once I’m out of the fitting room (always with a fussing baby) I decide to go look for a size bigger for the short so I could wear then right away…they didn’t have the size bigger…so I decided to not take the short and left them on top of the other ones…and start going toward a cashier and waited in line to pay…(with still a fussy baby)…as it is my turn to pay I realized that the tags of the pants are in the shorts….so I paid the shirt…with in my mind to go get back the tags inside the shorts…so I leave the cashier and as I’m looking my way back to the shorts and also the flip flop that intended to buy…I saw the purses and wanted to look at the price of a purse that I bought 4 days ago in the same store…to see if they had lower the price…so I went to look at the purses…but the baby is getting really fussy…and I decided to go inside the mall to feed her…knowing that I was to come back in this store later…and completely forgot that I was wearing the pants.

    As soon as I’m out of the store…a women came to me and ask me if I was having something that I didn’t pay in the store…this is when I remembered that I hadn’t pay for the pants I was wearing…so she brought me back where the security office and as we going she’s telling what I did in the fitting room (took the tags and put the pants on and put the short I was wearing in the stroller). Of course I still have my daughter that is getting fussier and crying…so she make me sign of trespassing paper that I cant go to Macys for the next year…and give me a another sheet and I asked her what I need to write on it… she said to write just what happened in the fitting room…which I did… Then I realized what was happening to me and start crying and couldn’t believe that my 1yr old daughter is in all this….I asked her what’s going to happen now…she said that they going to call the police…so I tried to explain to her how it happened but she told me to stop and wait for the police if I didn’t want to get my case getting worse.

    Also in the mean time the other security agent wants my driver license and is getting it from my wallet…and told me “you don’t have any cash hein?” I said yes about $75.00…

    So the police came and filed some paper and give me a court date…(and of course all I’m thinking is to get my daughter out of this) so I left….later the security called me to tell me that my wallet was in their possession and to come and get it….as I went to get it he told me that I had more money that I told them at the beginning…I knew I had money but didn’t know how much…I had about $150.00 and also I had a gift card of the store of $75.00 and a credit card of the store that I used all the time that I have a limit of around $2000.00 but only around $200.00 of purchases on it so about $1800.00 of credit available….I’ve been having an account with Macys-Burdines for about 10 years….and using it regularly (about 4-5 times a months) and had no reason to steal from the store I’ve been going for so long….so I was charged for shoplifting for $40.00

    Also I'm a permanent resident and had planned for months to go out of the country at the same time then my court date....tell me what I should do

    My response:

    You don't have a prayer, and all of this is just an excuse. You took the tags off, and you didn't need to do that for any legitimate purpose whatsoever.

    If I were you, I'd leave the country and never come back. We don't need any foreign criminals in this country. Do this crap in your own country!!

    I think I'd try to come up with a better story....or better yet, get a lawyer and have him come up with a better story.

    I'm thinking that bringing up the "fussy baby" an exorbitant number of times throughout the story was a nice touch.........NOT!!!

    If I had a dollar for every time I've had your kind of story in my apprehension room then I would've retired in 2001! But even after all this time I still find it interesting, and more than a bit amusing, to see the extent that (habitual?) shoplifters go to make it sound like it's their first time or that they are such a 'victim' of circumstance.

    Post an address so I can mail you a box of kleenex!

    Good natured humor, blunt assessments of legal situations, and even well-deserved sarcasm, are acceptable. Gratuitous insults, intentionally hurtful comments, and racism are not. We're all sufficiently mature here, I think, to understand the difference.
