    Default Consequence of Charges of Stealing a Car vs. Driving Without Permission

    My son's drivers licenses is under suspension for driving while uninsured. What would the possible consequences be for him, if he took my car without my permission? Would I have to press charges? I learned that this scenario "almost" took place the other night. He insisted that he was willing to take the risk because the cost of the fine would be less than the amount he would be saving. (he needed to get to a fax machine, to meet a deadline that evening to save him thousands of dollars) But, wouldn't that be considered"stealing" my car, or is there a different charge "driving without permission"? It is over with, and it really doesn't matter now, but just a dispute with my son. He is insisting that it still would have been worth it, even if he was caught. I say that it would be considered sealing. And, more serious than he thinks. If anyone knows, can they settle this arguement?

    Well, a second offense in PA for driving on a suspended license could result in jail time - the first offense is a "summary offense" with a $200 fine ... the second time around can be a different ball game.

    Additionally, the person permitting the unlicensed driver to take the vehicle (that would be you) could be charged with a summary offense AND could be liable for any damages incurred by the unlicensed driver.

    Also, the vehicle would be "immobilized" requiring you to appear before a court within 24 hours where you would have to show that your son now has a valid license or it would be impounded. If it is impounded, you would be requried to pay an assortment of fees and fines. You're lucky - in my state you would lose the car for 30 days in this circumstance, and the fees would be close to $1,000 (or more in some areas).

    If he took your car without your permission he could be charged with auto theft and sent to prison if you pursued it. If he took your car WITH your permission, you could be charged witht he aforementioned summary offense. If your son is willing to put you at risk and disobey the law for his own selfish whims, you need to reconsider at least parts of the relationship - particularly where he has access to your property.

    Thank you for responses. My son was son was under the impression that even if he did get a fine, it would be worth it. I am glad that I have proof that he was wrong.
    It is obvious that he hasn't learned a lesson from taking chances. That is what led him to lose his license in the first place. Hopefully, some day he will "get it". I just hope it won't be too late.
    He was so desparate that he was willing to chance taking my car while I was sleeping. Also, I was unable to drive due to medical restriction for 24 hrs.
    I would never permit him to use my car without a valid license.
