    Default Self-Defense and Gun Rights

    We represented a self-defense case in Detroit, Mi that brought into question the right to own a gun, shoot in self-defense and in defense of others. The Prosecutor fought us the entire way but we were able to win a NOT GUILTY verdict for our client Reginald Burks, a law abiding citizen who did the right thing. We want to share his story with the world, and change the way people perceive gun owners in Detroit.

    We'd love to hear your thoughts on the case. A brief summary, our client fired in self-defense, called 911, had a CPL and waited at the scene of the shooting. Police never investigated and later arrested and charged a completely random person for the incident. When our client found out he turned himselfm again explained to police what had happened and that he had his CPL. They charged him with 2nd degree murder and threw in him jail for 93 days until we could raise bond.

    interesting but I cannot seem to find anywhere R Burks 911 call is logged onto any 911 response unit. As well, it is odd that there was no response from the police when he reported multiple gunshots at his location. I know Detroit has a lot of problems but if a good citizen calls 911 to report they had just been in a gunfight, it would seem reasonable to presume the police would respond to the location.

    how was it determined (at least on your part) the window in the van was shot from inside? It would be logical to presume the amount of glass on the floor of the van could be utilized to determine a reasonable conclusion. If the shot was fired from inside, there would be much of the broken glass pushed outward and falling onto the road/ground. If entry was towards the interior, all of the glass would have been present inside the van.

    Personally, based on the overall actions of the parties in the van, I find it highly questionable they would be able to formulate such a claim and intentionally shoot out the rear window to support their claim.

    Heck in Louisiana you can shoot anybody on your land, no questions asked. That's why when I invite folks over for BBQ, nobody shows

    America: apple pie, baseball , and guns ....

    And a citizen has no legal requirement to call 911. I think that the guy could have shot him and watch him bleed to death & scream at him "ya gonna do that again? I think not!".
