    Default International Travel with Joint Legal Custody

    My question involves a child custody case from the State of: Michigan

    My son's mother and I have Joint Legal Custody. I have requested her permission to take our son on an international cruise and she is refusing to give me permission. She has not given any reasons specific to international travel just that she does not trust me or my second wife to take care of him during travel. I have made an appointment with my attorney to file a request with the courts for permission. I was wondering what are my chances of success? Is this a fight worth fighting or will a judge most likely refuse my request?

    Nobody can really guess - it depends largely on your past history with Mom (ie, neither of you threatening the other with kidnapping or other ludicrous acts ) - and this assumes that your court orders don't actually address international travel already.

    All things being equal and fair however, the courts are more inclined to compel the other parent when there is a Hague signatory country involved (versus non Hague countries).

    Very generally speaking, international vacations shouldn't be a problem unless there is a flight risk.

    It is pretty simple actually. You need to file a motion to have the courts grant you permission to issue a passport/visa or whatever paperwork is needed for your vacation in lieu of the other parents consent.
    If you file the motion on your own it should take a couple of weeks.

    I'm in Macomb County, and it is that simple.
    Make sure you have your itnerary and such that is all

    ...and of course there's no guarantee that a judge will issue such an order.
