    Default Cyber-Harassment

    My question involves criminal law for the state of: New Jersey
    I have recently recieved a charge of harassment from a friend of whom I sent one of those chain letters to in an e-mail. It was just a joke! Although some of the words were harsh, it was never intended to harass. My understanding is that in new Jersey, there is no law prohibiting cyber-harassment. Would that be a good defense? If not, how would I be able to beat it?

    Ummmm, think about this.

    "There's no law against cyber-harassment; therefore it's okay for me to cyber-harass you."

    Is that really what you want to imply?

    I have no idea if it's true or not that NJ does not have a cyber-harassing law, but I think you'd be much better off staying away from even suggesting that yes, it was harassment but it's okay because the law doesn't say otherwise.

    You 'received a charge' meaning you have been formally criminally charged? What's the statute you're charged with violating?

    Harassment can be charged under NJ 2C:33-4 whether the form of the harassing communication is "cyber" or not.

    Hi Aarvarc ....The e-mail was just a joke and not intended to harass or harm and was not directed toward her. It was simply a joke that tested your sence of humor, however, I never expected that it would go to court after being life-long friends!
    So, in other words, I shouldn't go to court without the help of an attorney, correct?
    Or is there a way that this can be resolved or reversed without risk of a criminal record.

    Yes, if you're charged with a crime it makes sense to get help from a lawyer.

    What's the statute you're charged with violating?
