    Angry Shared Tenant Parking

    My question involves landlord-tenant law in the State of: New York

    I live in a three apartment complex and my next door tenant came over the other day and told me yo move my truck so his girlfriend could park. parking is alongside the house and there are NO designated or RESERVED spaces, it is first come first serve only. he threatened to have my truck towed away if I didn't move it, he is the so-called "MANAGER" in the landlords absence but does it give him precedence for these kind of demands and can he tow me if i don't park where he says? I spoke to the landlord about this, and told my neighbor he does not own the place and leave me alone.

    As to the truck, is this a commercial vehicle ( with signs painted on the side), or just a personal truck?? Many towns and cities in NY does have prohibitions on parking of commercial type vehicles on the street, so you'll have to check.

    My dad owns a commercial property here in NY, and the regulations are if a vehicle is illegally parked, the police department has to come by first and slap it with a ticket. Then afterwards, the property owner can call a tow truck, and a licensed tow truck would not tow unless the vehicle has a traffic ticket on it, or the tow company can be sued.

    And unless local ordianances ban parking of the vehicle, a neighbor does not own public parking spaces on the street. Having said that, in many smaller towns, people consider spaces in front of their house their own. I rent a house to a tenant, and people down the street park in the public spaces in front of his ( actually my ) house, and he threatened to tow ( which he can't ). The landlord of that house had words with him, but my tenant was knowledgeable enough and told that landlord that he knows that house has MORE than the number of occupants, AND the units are illegal, so that landlord backed off.

    Another thing is the appearance of the truck. I had tenants park trucks in the driveway, and in front of the house and no one complained for over ten years. Then some tenant of mine got a roommate, and the roommate owns a rusty old truck with graffitti all over the side. The town was called and got after me for having an illegal vehicle there, and it did not even have a name of a business painted on it. I was told to get the thing outta there before I get hit with fines. I went over, took a look, and all my neighbors had beautifully manicured lawns, and that stupid truck just lowered property values by $20,000 for each property.

    In your case, if the truck is legal for the street, doesn't look like a rust bucket, your landlord has no problem, then I beleive you should be in the clear. I would check local ordinances first to be safe.
