    Default Constant Phone Calls

    My question involves restraining orders in the State of: South/North Carolina My wife and I live in S. Carolina. We have been getting phone calls at night (10pm or later) from a cell phone # in North Carolina. Typically the person is drunk and I have explained to them to stop calling. The person has been calling for over a week now.

    At this point, the phone calls persist and we have to turn off my wifes phone at night. When she turns her phone back on, there is usually 2-3 voicemails from this person. They will not say there name, but we do have the phone #.

    I know my wife can file a restraining order, but do we file it against the phone # and let the police find out who it is? Do you try to find out ourselves who the # belongs to? Do we file the R.O in South or North Carolina?

    Why can't you just block the calls from that number? A whole lot cheaper and easier than obtain than a restraining order! Especially given that you'll have to somehow get the phone caller in a courtroom with you to get said restraining order...

    If you don't know how to block the calls, call your phone service provider. They can do it, and if there's a fee, it will be worth it.

    Courts in SC are unlikely to issue such an order, because unless the messages indicate that you are in some sort of emmanent danger, the person is in another state and not a danger to you. Your BETTER course of action is to file a report with your local police and turn over a record of the received calls. Also, for cell phone accounts, if your wife wanted to change her phone number, almost ALL carriers will do so for her free of charge if her reason is harassment. You didn't specify if you actually know the IDENTITY of the caller....do you?

    Have you thought about calling the number back at a reasonable time and explaining that you aren't whomever he is calling?

    Restraining orders don't keep half-literate jackasses from drunk dialing you.

    Depending on her carrier, she may be able to have the number blocked. It's usually a simple matter of calling customer service, explaining the situation, and asking for a block. If her carrier can't block the number, she can also - depending on her model of phone - simply set a silent ringtone for the number and set it to go directly to voice mail.

    We have tried to call back and the person will not answer. I have left 3 seperate voicemails asking that the calls stop, with no such luck.

    We are going to block the # on her phone. We do not want to get rid of the # she has now, because she has had it for 7 years. I am sure everyone knows what it is like to get a new # and then have to tell everyone about it.

    I know that the RO would not stop them, but if it is the person we think it is, it would stop them. They are a cop and this would be very bad for that person to have an RO out against them. We just cannot prove that it is them.
