My question involves an ROW in the state of Rhode Island: My question is in reference to a ROW that abuts seven properties, to include mine. My house was built in 1890. I had a title search done and they went back to 1918. For whatever reason they didn't go back to 1890. In the oldest deed it mentions the ROW as a "cart path". A contractor bought two lots at auction. Both lots have dwellings (140 years old) on them. Both lots have been owned by the same people. Both lots have been accessed from a side street (not the street my frontage is on). The front dwelling has a house and a lot size of 5506" and the back dwelling was a barn/garage that was converted into an apartment and has a lot size of 12599". He wants to now use the ROW to access the back lot as sell off the property as two lots. The town is telling him no but I'm not taking any chances and want to do all of my homework. The ROW starts on my street, is 20' wide and goes 321" before it turns on his property. My dwelling has used the ROW as a driveway and yard since it was built. The driveway portion is about 125" before it turns in grass and the remainder is grass. The ROW has never been used or improved. RI has a statue (Section L) that says the town is to combine the lots but the assessor kicked it back because there are dwellings on each lot. I have the town backing me so far but I'm not sure if they can hold him off for much longer. What are my options?
