I have a question regarding my legal options concerning an individual living in my basement. This person is a non-paying tenant and was allowed to live down there by me via a verbal consent so that he could get back on his feet after losing his job (strongly encouraged by my wife). The issue now is that it has been nearly 5 months now and I'm finding his behavior with my wife offensive and their relationship seems to be growing while mine and my wife's is deteriorating (we were having issues prior to him moving in; however, it has simply multiplied our issues 100 fold having him here). Both of our names are on the title of our home, I want him gone, and my wife wants him to stay.
When there is a dispute between owners of the same home regarding a non-paying tenant, does the law side with the one requesting that that person leave? What are my options?
I live in Arkansas if it varies by state. I have been the primary breadwinner for the duration of our marriage as well if that matters.
Please help. I have given him a 3 week notice to remove himself and all his property by that date. However, when that days comes if I am able, I'd like to have him peacably removed by an officer of the law.
