    Exclamation How Long Before CYS Acts on a Report

    My question involves child abuse or neglect in the State of: Pennsylvania

    Two girls age 15 and 12 went to school counseler and told them of what they have been experiencing at home from their father. They both ran away at one point, they are subjected to his heavy drinking, and yelling, and ask to "scratch" his head. He is physically abusive to his GF, they children have heard her yell to "stop, you are hurting me" during one of their arguments. He has threatened to "F**k" up" the 12 y.o. for not scratching his head, he has threatened to "punch your teeth in" to the 15 y.o. because he wanted the telephone # to her real mom's BF's daughter. He has shown them naked pics of their real mom having sex.

    With that being said, they have gone to school counseler and the 12 y.o. was told that they have contacted C.Y.S. It has been 2 weeks now and they have not heard anything else, and the girls are curious as to what is going on..... They want to live with their mother and she is in the middle of filing for custody modification.

    The real mom does not have physical majority custody because she fled the home with the children to a nearby state (her parents) and successfully filed a PFA against her husband, however, the courts found it to be in the best interest to keep the children with father since he remained in the marital home, and did not want to distrupt their family life such as changing schools, and at that time their older half siblings lived there (they no longer do)

    Wondering how long it takes for C.,Y.S. to step in and interview the children?

    CYS goes through a screening process; even when a mandated reported (such as the school counselor) makes a report, the call is screened to determine the priority. After two weeks - assuming the counselor DID actually make a report - it would at least appear on the surface that this is not a priority case.

    That aside though, Mom frankly needs an attorney - she's not just asking to change custody, but apparently also wanting to relocate the children out of state. That's not easy.

    What did CYS say when MOM called to inquire?

    Thanks for replying so quickly!

    Mom first called the Child line 2/2/11 after hours when the children first ran away. They ran to the neighbors house and called their half brother and their mother to come get them. Half brother and daughters met MOM at the State Police Barracks and the State Police made them return to their father. At first they told MOM that this was a civil matter and they were not getting involved, however when father called 911 to report missing children, the State Police realized they were the same children, and told father where they were and DEMANDED they be returned to him and they then enforced the custody agreement. Child line reported to their supervisor, and a supervisor called MOM back and took information and that was the end of it.

    Also, MOM is back in the state of PA, she lives only 5 miles from children, however it is a different school district.

    Would it be advisable to have MOM call C.Y.S. and inquire if the school system has filed any information on these two girls?

    Mom needs to find out if there is an active investigation going on.

    However, nothing you've said actually indicates abuse or neglect - just that two kids have run away a couple of times.

    On what basis is Mom trying to change custody?

    Mom is trying to change custody because the children have stated that they do not want to continue to live there. They are scared to death of him. They have witnessed him throw their older half brother through the front window of the house (hence he is 19 y.o., and no longer lives there) this past year. They are scared of his threats of punching them in the mouth. He grabs them by their face and shoves them against the wall when they don't do as he wants, I'm not talking about homework and household chores, he asks them to do degrading things as scratching his back and head for and hour or two each evening. 5 out of the 7 nights a week he is drunk. They have returned home to find all the live in girl friends personal items thrown out in the yard.

    I guess what I am trying to say is the basis to change custody is that it is the wishes of the children, and the MOM does not feel that it is a proper/safe environment for them to live in.

    This doesn't appear to be abuse/neglect?

    When MOM calls C.Y.S. should she indicate who she is and why she is inquiring?

    (Who are you in this? You keep referring to Mom in the third person....)


    So, what PROOF is there of ANY of this stuff?

    (For what it's worth, Dad drinking every night, being a twit to his girlfriend/ex, throwing gf's stuff out, none of this is abuse or neglect - but I'd like an answer to my question before I go further)

    I am the aunt in this situation. I am trying to help out my sister and her children. "MOM" was sitting next to me when I was posting yesterday evening.

    There is not any real PROOF, only what the girls state, and the neighbor when they ran away.

    ...so there's no proof at all.

    Mom has an uphill battle on her hands to change custody.
