    Default I Want to Sue Tobacco

    My question involves injury or loss that occurred in the state of: Arizona

    Can this be done and what are the criteria?

    I posted this under "Personal Injury Issues" not "Defective Products"

    Cigarettes aren't defective products. Defective would implicate that the company sold a product not to their considered standard for that product. Cigarette companies sell their products the way they are knowingly and willingly.

    I think you will have a hard time suing a plant. Even if you won, how would you expect tobacco to pay? and since there are millions of tobacco plants, would you sue all of them or do you have a particular plant in mind?

    well, is there something inapplicable in light of your original post? You are going to have to provide some information in order to get an answer and you have provided almost no information.

    Yeah, I was going to supply information until I read the directions above saying don't supply information.

    I did however ask criterion for these types of litigation's and was trying to illicit information regarding the possibilities as I know in 97' big tobacco bought their immunity from class action law suits with some $560 billion to the FDA.

    well, "these types of litigation" wasn't broached in your first post. While I could read into the post that you were speaking of some sort of litigation due to some user of the product getting cancer (that is what you were getting at, right), there have also been a few other types of suits against "tobacco" that were not restricted by the payment to the government. Offhand, one I can think of would be the suit against the makers of Camel cigarettes for their particular type of advertising. RJR Tobacco has paid out over $10M in settlements for suits involving advertising and this was after the big FDA payoff.

    the information you are cautioned about would be anything that would personally identify you or cause you any sort of problem with it being made public.
