    Default What can I do for emancipation?

    i am a 17 year old female who lives in florida and i am wondering what my options are as far as emancipation goes. heres the details:

    i have a job to support myself

    i used to live with my mother as of 2 months ago untill she moved 70 miles away...so i moved in with my dad so that i could finish up my senior year

    my father became angry and upset and was verbally and emotionally abusive

    my parents are constantly fighting over custody of myself and 2 younger brothers

    putting me in the middle of their fights

    after my fathers latest blowup (my mother was in town) she took me to a friends house and she then filed a child abuse report against him

    now she has taken me (against my will) to her home and refuses to let me go back to my home

    i do not wish to spend my most vital school year away from family and friends but my mother does not wish to compromise. so if someone can help me come up with any other options other than emancipation it would be greatly appreciated. i do understand however that i do need parental consent to become emancipated but what can i do with all of my factors?

    Perhaps your parents will agree to let you reside with a responsible adult (e.g., a close friend and her parents) while you finish your senior year. When you turn 18, you can live where you choose.

    well weve talked about that but my mother insists that theres no one she can find and my father wont have me live with someone else...he thinks theres nothing wrong with me living with him

    Well, you have about 11 months to go before you're 18 - - which is automatic emancipation in Florida. However, emancipation requires very specific facts on your part because a judge wouldn't want you to be a minor who is dependant upon State Aid for your subsistence; e.g., a job that can pay you enough for the necessities of life, like an apartment, food, utilities, clothing, etc. Also, even if you could legally exist outside of the care of your parents at this time, it would take about 11 months for you to finally get into court, after all the legal delays and wrangling.

    Emancipation is taken very seriously by the courts, and judges tend to scrutinize the facts exceedingly carefully and whether you meet the minimum State guidelines. In other words, judges "look" for reasons not to emancipate, rather than the other way around.

    Your best hope, at this time, is to "stick it out" until you're 18, and then move out.

    With Florida's peculiar emancipation statute, a minor's parents (or guardian) must file the petition to initiate the emancipation proceedings. So Florida teens frequently are "stuck" when their parents oppose emancipation.

    You're welcome, young lady. Sometimes, though, "adulthood" isn't all that it's cracked up to be. I understand, to some degree, what you're saying; but, being an adult with all of its responsibilities realized "before your time" can be, and in most case is, very difficult. Heck, for that matter, it's very difficult for most even after they've reached that "magic number"!

    Consider yourself fortunate that you don't have to wait until you're 21, like the law used to be many, many years ago. That's a whole other story!!
