    Default J1 Getting Married with a U.S. Citizen

    Hi,

    I am a Portuguese citizen, holding a J1 visa for 18 month, the 2-years rule does not apply. I am engaged with a US citizen guy and we are planning to get married as soon as necessary. I am a trainer for a French company, and they might be interested to contract me afterwards, my visa ends in July and I do not know what are the possibilities that I have to stay here and also be employed by my company.
    Is this idea possible: end my J1, then get a fiancee visa, in the meantime get a French contract even if I will be based in the US, and then get married, apply for the green card, and finally get a local contract.

    I'm really concerned about this topic.

    You can marry any time you would like. If you marry during your present J1 stay you can decide if you want to try to adjust your status based on marriage (as you're not subject to the two year rule) or if you want to leave when your J1 ends and apply to reenter on a spouse visa. If you choose not to marry, once you return to your home country you and your fiance can seek a fiancee visa and, once you obtain it, enter on that visa and marry within 90 days, then petition to adjust your status based on your marriage.

    If you choose to marry and adjust your status you can seek employment authorization (EAD) in association with your petition to adjust your status and, if granted, you'll be able to legally work on that basis without restriction as to your employer.
