    Default Punishment for Misdemeanor Battery, 2 Counts, No Criminal History

    My question involves criminal law for the state of: Indiana

    Can I get an estimate of a likely punishment?

    Two counts of misdemeanor A battery charge. No prior criminal record at all.

    Depends on the facts of the case. Not having a record might help, but sentencing is dependent on ALL the facts. It could be anything between zero and the maximum. Depends on the judge. Depends on what the victim asks for. Depends on the nature of the crime itself, etc.. Here's what the law allows you to face:

    IC 35-50-3-2
    Class A misdemeanor
    Sec. 2. A person who commits a Class A misdemeanor shall be imprisoned for a fixed term of not more than one (1) year; in addition, he may be fined not more than five thousand dollars ($5,000).
