    Default How to Terminate Probation and Convert Restitution into Civil Lien

    I was adjudicated withheld in a grand theft but put on probation until i paid my restitution of $20,000 back or 7 years. I have become disabled and am on social security disability and have mental issues also. I have been on probation for over 3 years. How can I terminate my probation in Florida and convert the restituion to a civil lien since there is no way I could ever pay it back? I was told I could do this.

    Pursuant to Florida Statutes, Sec. 775.089, the judge may convert the unpaid portion of your restitution to a civil judgment at the end of your probation. You're free to ask your probation officer to consider an early discharge. You have no right to an early discharge.

    The belief is you may not be able to pay today but you might be able to pay tomorrow. So you should not find Fl. DC making any effort to term your supervison early. It is not politically correct particularly since there is a Victim. The 7 year probation suggests that it is a F2 felony so at the end of 7 years and not being paid there would be a V.O.P. with the likely outcome of 5 more years probation. (F2 punishable by 15 years). Suggestion, you or someone else begins paying something monthly on your obligation so you have some bargaining at the end of the probation. Sometimes the Victim will take a lump sum lesser amount to get you out of their lives. (Beware of no contact clause!). If common sense fails hire a lawyer.

    I am paying monthly all that I can afford. I'm on disability and can't even buy food, but I pay something on the restitution every month. I am on permanent disability so there isn't any future of me making enough money to pay this off. I have severe medical conditions that won't get better, ever. The probation is hard on my medical conditions and all I want to do is convert the resitution into a civil lien and get off probation. If some majic fairy comes along and gives me $20,000, then I guess the civil lien will take care of that.
