    Default Statute of Limitations on Suing Over Abuse

    My question involves child abuse or neglect in the State of: WA

    I have recently seen evidence of abuse of a loved one that is 1 month shy of their 22nd birthday. Victim was approximately 4 years old, extensive bruising (black/red/purple) on backside from shoulders to backs of knees. Abuse was done by stepfather of victim. CPS was called, nothing ever done. There are statements from the father, grandmother, and photos that were turned in to CPS.

    My question, can charges still be filed on the step father for this abuse or has time ran out? He has nothing and is an idiot, but I believe he still needs to pay for his crime(s). This happened more than once, but the proof remains for the one time. If charges can be filed, would they be felony or misdemeanor? Would it be child abuse or assault/battery?

    If you are saying that the abuse occurred when the victim was 4 years old and is now 22 years old, the statute of limitations has long since expired. It could be classified as any number of things, from child abuse to assault/battery. It doesn't matter though because the SOL for felony and misdemeanor charges is long gone.

    I cannot find any tolling for the sol for an action against a child that is not sexual in nature. If it were sexual in nature, the sol would have tolled until she turned 18 and then the 3 year sol would start running.
