My question involves adoption law for the State of: Florida
I was married before my current husband. During my first marriage I was rapped. My first husband and I were separated. I was never given anything incase of a rape because my husband at the time was in the military and didn't want any "drama." I learned I was pregnant and my husband said that no matter what he wanted to be the baby's father. I however wanted an abortion because after all, I was "made to have sex" with someone I have no idea who he is. Its horrible to have to live with.
Long story short, I did end up having the baby who I love and adore. My ex husband knows he is not the biological father and since then couldn't handle it and we split up. Because we were legally married his name was automatically put on the BC. When I divorced the papers said that he "knew" he was not the biological child and that he would agree to a step parent adoption if I didnt' ask for spousal or childsupport. Of course I didn't and I have met a wonderful man who loves my daughter.
My problem is, how can my current husband adopt my daughter if I don't even know who the biological father is? I can't even get my ex husband to contact me to figure out what he needs to sign. He feels in the divorce papers he would agree to it. I have no idea where he is at. It's been 8 years.
Any advice? I do not want my daughter to think she is the product of a rape. When she is in the reality the best thing that has ever happened to me.
