    Unhappy Can a Felon That Owes Restitution Get a Passport/Visa

    My question involves a background check in the State of: WASHINGTON

    I am a student who was convicted of theft in the first degree (felony). I have been invited to participate in a study abroad program in Paris for 5 months (I will need a student visa), however I have never applied for a passport.

    I owe about $4,000 in restitution and am worried that my passport will be denied because I owe this debt.

    I also worry that I will be denied a student visa because of the felony charge (I was convicted in 2008).

    Does France/the US have laws restricting me to obtain my visa?

    Does the US had laws restricting me to obtain a passport?

    HELP!

    If you're on probation, the hold-up may be that unauthorized international travel would violate the terms of your probation.

    I'm not sure where you get the idea that your restitution order, if unrelated to child support, will create a hold on your passport application. If you want, you're free to scour the U.S. Code, Code of Federal Regulations and State Department website for information about any such hold; I'm not about to try to prove a negative.

    If you have a child support hold with the State Department, you won't be able to get a passport. We cannot investigate whether or not you have a hold.

    We have no way of telling you if France will issue a visa to you given your criminal history. That would be an issue to address with French immigration officials or an immigration lawyer who practices under French law.

    I don't know how/why this ended up in the Emancipation Law forum.

    Thank you for answering my question. Do you know of any online resources that would have this information? Do they ask about your criminal history when applying for a visa?

    French immigration officials and French immigration lawyers have information about French immigration law. If you speak French, you are free to go to Google and enter French search terms to search for French legal information.
