    Default Statue of Limitation for Felon with Firearm

    My question involves criminal law for the state of: Alabama
    my boyfriend turned himself in and is being charge as a felon in possession of a firearam. they are tryn to use his past convictions to make time longer, there saying 15 yrs. so what is the amont of time given with 1 prior conviction for a felon in possession? and whats the statue of limitations on this matter?

    They are free to use his prior convictions to argue for additional incarceration time. We cannot tell you what the sentence will be as there are a number of variables in play. When is the crime for which is he is being charged alleged to have happened? Was there a warrant issued?

    I think your BF needs to, until such a time as he gets his right to possess firearms restored, stay away from them...to include going to people's homes he knows to possess firearms.

    thanks. this all happened early last year. yes a warrent was issued about 4 weeks ago thats why he turned himself in. i was just trying to find a way to get the time lowered if possible. he goes to court on 7th of next month for sentencing. with federal would they or could they do a split sentence??

    If he has prior convictions, especially if they are for similar/same charges, it is unlikely that they will consider a split sentence. Could it happen? Sure. I could win the lottery this week.

    Based on the time frame you indicate, SOL is not a factor in this case.

    Is he being charged by Alabama or the US Gov't?
