    Default Reopening a Order

    My question involves child support in the State of: NJ

    What is the likely hood of a closed case being reopen a year later or a new case created after the old case has been closed for a year. Reason child decides to go back to college after taking a year off? Is it something that is easy to do?

    This is really a sort of "well, it's really anybody's guess" kind of thing.

    I don't recall the actual terms of your order, but very generally once the child is considered emancipated it is difficult for petitioner to "un-emancipate" the same child.

    (and I know that's not a real word )

    However, I AM aware of cases where that has happened. I cannot remember offhand if any of them were specific to NJ though.

    The NCP in my situation ended the Court Order today...(not sure why), but as she was hanging up the phone after telling me, she said "If you don't commit to sending money if she (our Daughter) decides to return to college in one year I have been told I can get the case reopen."

    I pretty sure my daughter done with college because if she already in the hole for $50,000 student loan and going the remaining two years would be another $50,000. That the reason the mother was not pushing for her to continue and I am sure it will be the reason she doesn't push her too in a year from now. So I am not worried. But I will make sure I keep a little on the side so the initial shock of paying again doesn't stress me out like last time.

    I haven't gotten any paperwork, so maybe there is some veribage on it about possible reopening the case or being temporary closed. I am sure I will post questions if there is.

    Thanks again for your quick response....I feel a little bit better.
