    Default How to Bring My Fiancée to the U.S.

    Hello Everyone,
    I have a question in regards to status of my future wife. Here is the scenario. I am a permanent US citizen (Green card holder) working full time and wife to be is a UK citizen. After marriage she is planning on moving to USA with me. I have looked around on the web to get a clear answer so I know what my options are but the more I read the more I get confused.
    I am planning on getting married in Oct or Nov and am not sure how long will it take for my wife to come here to stay with me. I know that she come to US without a visa for 90 days but while she is here I won’t be able to do a status change for here as that would be considered illegal or fraud.
    Now I know she has a option for coming here on student visa but that will not work as she is already working in UK and has no further plan on studying. I have read on other forums that I can file for a I-130 forum but to my understanding that process takes forever.
    Is there any advice that someone can give me on how to go about this process so that I can bring my future wife to US as soon as possible. I read somewhere that I can go to US and do a court marriage and then file for papers there. I have no problem doing that as long as it is not too expensive. But, then again I am not sure how long that process will take.
    I have already contact my lawyer in regards to this matter and have a appointment with her in 3 weeks. In the mean time I am trying to see what my options are so that I can have a better understanding before I go to my lawyer and ask her the right question.
    Any help in regards to this matter would be greatly appreciated.

    If you want her to come to the U.S. and marry you in the U.S., then stay in the U.S. to adjust her status, seek a fiance visa. If you want to marry her, whether here or elsewhere, then after the marriage seek a spouse visa for her immigration from the U.K.

    Since you are only a green card holder, she would have to wait outside the US for a visa number to be available; check the Department of State website for the current Visa Bulletin. In order to enter before that time, she would need to obtain a dual intent visa such as H1B or L1.

    With the VWP, she cannot have immigrant intent which she obviously does. She should expect to remain in the UK until she is granted her green card.

    If you become a citizen, the visa number becomes available immediately, and the wait is a couple of months for paperwork processing.

    Thank you very much for your response. if i do stay here and get marrie din the US will he have to leave the US till she get her fiance visa or will she be able to stay here with me till here paper work is all sorted out.
    I just need to know my options so that i can lay them out to my layer with whome i have a apointment tomorrow.

    You have hired a lawyer. Let him lay out the possible scenarios. That is what you are paying him to do.
